1. Acceptance of Terms
By accessing or using ButtonLeads, you agree to comply with and be bound by the following terms and conditions ("Terms"). If you do not agree to these Terms, please do not use the CRM.
2. Use of the CRM
2.1. You must be at least 18 years old to use this CRM.
2.2. You agree to provide accurate and complete information when registering for ButtonLeads.
2.3. You are responsible for maintaining the confidentiality of your account information and password.
3. Data Protection and Privacy
3.1. ButtonLeads collects and processes personal data in accordance with our Privacy Policy, which can be found Here.
3.2. You consent to the use of your data in accordance with our Privacy Policy.
4. Intellectual Property
4.1. All content and materials available on ButtonLeads are protected by intellectual property laws.
4.2. You may not reproduce, distribute, modify, or create derivative works of any content without our written permission.
4.3. Any automations, templates, workflows, sites, or other customizations added to an account may be used or added to other accounts.
5. Service Availability
5.1. ButtonLeads strives to provide a reliable and available service, but we do not guarantee uninterrupted access to the CRM.
5.2. We reserve the right to modify, suspend, or discontinue any part of the CRM at any time.
6. Limitation of Liability
6.1. ButtonLeads is provided "as is" without any warranties.
6.2. We shall not be liable for any indirect, incidental, special, or consequential damages.
7. Termination & Insufficient Funds Deactivation
7.1. We reserve the right to terminate or suspend your access to ButtonLeads at our sole discretion, without notice, for any conduct that we believe (a) violates these Terms or is harmful to other users; (b) infringed the intellectual property rights of ButtonLeads; or (c) violated or acted inconsistently with the letter or spirit of these Terms of Use. You agree that any deactivation or termination of your access to the Services may be effected without prior notice to you and ButtonLeads shall not be liable to you nor any third party for any termination of your account or the Services.
7.2. In the event of insufficient funds for the subscription payment, the account holder acknowledges and agrees that the account will be subject to deactivation if the outstanding payment is not rectified within a grace period of three (3) days from the due date. The account holder is solely responsible for ensuring that sufficient funds are available to cover subscription charges, and failure to remedy the payment shortfall within the specified timeframe may result in temporary or permanent account deactivation. Reactivation may be subject to additional fees or conditions as outlined in the terms and conditions.
7.3. In the event of account deactivation due to insufficient funds and subsequent non-payment within the specified grace period, the account holder acknowledges that ButtonLeads reserves the sole discretion to refuse reactivation of their account. If the account holder opts not to rectify the outstanding payment and reactivate their account within the specified 3-day grace period, ButtonLeads may, at its discretion, choose not to allow reactivation. The account holder understands and accepts that such refusal may result in a permanent discontinuation of access to the subscription services.
8. Governing Law
8.1. These Terms are governed by and construed in accordance with the laws of Texas. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Texas.
9. Changes to Terms
9.1. We reserve the right to modify or update these Terms at any time. Continued use of ButtonLeads after any changes indicates acceptance of the modified Terms.

10. Refund Policy
10.1. We strive to ensure that ButtonLeads operates efficiently and meets the expectations of our users.
10.2. Refunds will only be issued if ButtonLeads does not function as expected, subject to the terms outlined in our Refund Policy, which can be found https://buttonleads.com/refund-policy.
10.3. No refunds will be provided in cases where issues arise due to user error, misuse, or failure to comply with the instructions provided in the CRM documentation.
10.4. Users will always incur the costs associated with A2P 10DLC brand and campaign registration, including any additional campaign fees that may apply. These costs are non-refundable.
10.5. To request a refund, users must follow the procedures outlined in our Refund Policy.

11. Disclaimer of Warranty
11.1. ButtonLeads is provided without any warranties, express or implied.
11.2. We do not warrant that ButtonLeads will meet your specific requirements or that the operation of the CRM will be uninterrupted or error-free.
12. Limitation of Liability
12.1. ButtonLeads shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses resulting from the use or inability to use ButtonLeads.
12.2. Users acknowledge that the use of ButtonLeads is at their own risk.
